The main question is: if there is a legal dispute how can I get justice and enforce a contract?

Much depends what the contract says on the law governing the agreement. ie does contract say it is subject to Iraqi law or foreign laws?

You can only enforce a ruling in Iraq if the foreign court is in a country which has signed the Riyadh Convention.

Methods of enforcement

  1. Local Iraqi courts: not recommended; especially if a high value claim
  2. Local arbitration: not recommended; there is only one arbitration forum in Najaf.
  3. Foreign arbitration: for example the DIFC court in Dubai. But note there is no record of a successful enforcement of foreign arbitration in Iraq.
  4. Action in a foreign court, you can only enforce a ruling in Iraq if the foreign court is in a country which has signed the Riyadh Convention.
